Hi Sherry,

I realize this is a little outside what you might specialize in, but I have a legal question regarding the obligations of a clinic/doctor around an IVF cycle.

I just recently finished my 4th IVF cycle, which resulted in a BFN. During the cycle, I had about 11-12 good size follicles. In the past I always triggered around day 12, but this time they triggered me at day 8. Two times during the stimulation phase I asked them was this normal, and they said yes. They retrieved 11 eggs, only 3 were mature and 2 fertilzed.

We were devasted and when the doctor called us to tell us this, my first question was did you trigger me too soon and he said yes, that was a possibility. He said if we do another cycle, they would keep me on the meds 1 or 2 days longer based on my past history. It was almost an admission of error.

Based on this, do you think there is anything I could do to obtain compensation for this cycle. Ideally I would like them to offer me a free cycle to make up for this one - that's all I'm looking for. I feel the care they gave me was comprimised and I had to pay the price. Should I seek the advice of a lawyer?

No, it was my 3rd IVF at this clinic and I had also done 2 IUI's with them. I've been a patient for years. My first 2 IVFs were at this clinic - first one was chemical pregnancy, 2nd one there was no transfer. 3rd IVF at new clinic resulted in DS. We decided to go back to original clinic (this one) because they agreed to all our conditions and we thought they would be ok. During the stimulation phase when you go in for u/s and b/w you meet with the doctor on call to go over your results. The doctor changes daily - the entire file is in my binder which they refer too, including my previous IVF - on more than one occassion, they asked us if this was our first IVF...on the day of the transfer, the doctor asked us if this was our first transfer!! They clearly don't read the files, which are right there... and I asked them to tell me how many were mature, I was concerned they were triggered me earlier than before and they said 11 were mature and it was time. So I was shocked when I got the call the day after my transfer to tell me only 3 were mature, 2 fertilized and I was having an emergency day 2 transfer.

I can certainly understand your frustration with the clinic. The first step is always sitting down with them and voicing your concerns. They should offer you some concessions. Good luck.
