I'm a single woman planning on using a known sperm donor and we are both concerned about parental rights. We both agree that I will be the sole parent and he will not be listed as the father. I've read about sperm donor contracts but most of my research has been U.S based. What is the process here in Canada and does it matter if the donor is from the U.S?

Me - 40; DH - N/A
BCP for 21 yrs (yes you're reading this correctly, LOL)
Jan/12 - referral to RE; going thru infertility testing

Hi Balki,

The laws of the province in which the child resides will govern issues such as child support and custody. Have you also discussed child support? Custody in the event of your death? Disclosure to the child? Confidentiality with respect to the rest of the community?

The process is the same here as it is in the US. You should both have your own lawyer and you should be aware of the law before you make your final decisions. You can discuss the value of a contract when you meet with your lawyer.

As always, I'd be happy to help.

Hi Sherry,

I realize that this question was answered quite some time ago, but what would be the best type of lawyer to address the type of situation mentioned in the original posters question? Should people consult a lawyer who specializes in family law? Would you have any contacts in Gatineau, Quebec?

Thank you.

This is from Ms. Levitan's website:

"Lawyers, like doctors, specialize in different areas of the law. Find a lawyer who is actively involved in third party reproductive technology and don’t be afraid to ask about his/her experience in the field. Many family law lawyers list surrogacy as an area of expertise, yet they have never actually acted in a surrogacy agreement. You shouldn’t be their first or even tenth client."

Maybe try the law society while your waiting.  Here is the link
